1. Seller and contact details
Paced Learning is the trading name used for the supplementary math practice service at https://pacedlearning.ca. Legal seller: [LEGAL NAME TO BE CONFIRMED]. These seller details must be completed before this draft is used for card enrolment. The subscription agreement will consist of these terms, the educational disclaimer and your order confirmation identifying the student, selected course, billing option, trial end time, first charge and renewal schedule.
2. Who subscribes and what is included
The person purchasing the subscription must be at least 18 years old. Where the learner is under 18, a parent or legal guardian purchases the subscription and authorizes the learner to use the course. We may ask for confirmation of that authority.
Each subscription is for one named student and one selected course. It includes access to that course’s available lessons, explanations, examples, practice questions and account saving features while access is active. It does not include live tutoring, school enrolment, academic credits, official grades or certification. Grade 11 and 12 courses are not included and are not yet available.
Your order confirmation identifies the course you selected. Access is for individual learning; do not share your login, resell access, publish the course or bypass access controls. You keep ownership of your own written working. You allow us and our service providers to store and process that working to provide the service.
3. Seven-day free trial and card requirement
New eligible students may receive one seven-day free trial of the selected course. A valid credit card is required at trial enrolment, but no subscription fee is charged during the trial. A payment provider may verify the card using a temporary authorization rather than a completed subscription charge; any such verification must be explained at checkout.
The trial lasts seven consecutive 24-hour periods from the activation time stated in the order confirmation. Checkout and the confirmation must state the exact trial end time, with its time zone, and the date and amount of the first payment. A trial-ending reminder will be sent before the first charge.
Unless you cancel before that trial end time, the trial automatically converts to the billing option you selected and your card is charged the disclosed amount. If you cancel before the trial ends, no subscription fee is charged and trial access ends at the trial end time. A further trial is not automatically provided when changing a course or returning later.
4. Prices and billing periods
Monthly: CAD $75 charged at the start of each one-month paid period. Quarterly: CAD $200 charged upfront at the start of each three-month paid period. The quarterly option saves CAD $25 compared with three monthly payments of CAD $75. It is paid together upfront. The first paid period begins when the trial ends.
Prices apply per student, per selected course. Applicable taxes, if any, must be itemized before you enrol. There are no additional mandatory service fees. The total first charge, renewal charge and renewal dates will be shown in your order confirmation.
The subscription continues for successive monthly or quarterly periods until cancelled. There is no minimum number of paid periods and no cancellation penalty. Selecting quarterly billing does not provide an automatic partial refund for unused months; the refund policy and your statutory rights still apply.
5. Consent, confirmation and payment handling
Before activating a card trial, you must be able to review the selected course, billing period, trial deadline, charges, cancellation method and these terms; correct errors; and explicitly accept or decline. Card submission or browsing this website alone is not an agreement to recurring payments.
Your express authorization permits the payment provider to charge the first payment after the trial and later renewals at the disclosed frequency until you cancel. Consent to marketing messages is separate and optional.
We will email a copy of your order confirmation and the terms you accepted in a form you can save or print. Card entry must use the designated payment provider checkout. Do not send card numbers, security codes or passwords by email. Deleting your payment card or signing out does not by itself cancel the subscription.
If a payment fails, we will notify you. Paid access may be paused until payment is resolved. We will not treat a failed payment as consent to a different price or a new plan.
6. Cancel future renewals anytime
You can cancel by emailing info@pacedlearning.ca from the purchasing email address, identifying the student account and asking to cancel. You do not need to give a reason. If a self-service cancellation option is provided at checkout or in your billing account, you can also use it.
Cancellation is effective for future renewals when your request is received, rather than when staff finish processing it. Send the request before the displayed trial end or next charge time to avoid that charge. We will confirm the cancellation by email. If a charge is taken after a timely cancellation request, we will refund that charge.
After cancellation during a paid period, access continues until the end of that paid period unless you request and receive a refund that ends access earlier. Cancellation stops future charges; it does not automatically request a refund of a payment already made.
7. Fourteen-day first-payment refund guarantee
You may request a full refund of your first subscription payment by emailing info@pacedlearning.ca within 14 consecutive 24-hour periods after that payment was taken. This voluntary guarantee applies to the entire first payment for either billing option, including CAD $200 for quarterly billing, and to any taxes collected with it. No explanation is required.
The seven free-trial days do not count toward this refund window. The guarantee is available once per student’s initial paid subscription; it does not restart with each renewal, course change or new trial request.
An eligible refund request also cancels future renewals. Course access ends when the refund is approved. We will initiate the refund to the original payment method within seven calendar days of receiving an eligible request; your card issuer may take additional time to display it. Any shorter applicable statutory deadline prevails.
Outside the first-payment guarantee, subscription fees already paid are generally not refunded simply for changing your mind, partial use or forgetting to cancel. This does not restrict refunds or other remedies required by law, charges taken after a timely cancellation, billing errors, misrepresentation or failure to supply the agreed service. Contact us if the service has a material problem.
8. Switching a plan or a course
Ask info@pacedlearning.ca to change the billing option or selected course. A change takes effect only after we confirm the new course, price, effective date and any adjustment, and you accept it. There is no automatic prorated credit or retroactive change under this draft.
A change does not create a new free trial or first-payment guarantee. We will not charge the new amount solely because you made an enquiry.
9. Service access, saved work and technical issues
A compatible web browser and internet connection are required. Course and account access require an online permission check even when the site is installed as an app. Availability can be affected by maintenance, internet failures or third-party outages. Report problems to info@pacedlearning.ca.
Use available save and export controls to keep copies of important work. Expiry or cancellation can prevent access to course content and saving tools. A subscription is not a promise of permanent storage. Cancellation of billing is separate from an account-data deletion request.
We may temporarily restrict an account to address a security issue or serious misuse. We will give a reason and an opportunity to resolve the issue where practicable. Such action does not authorize charges for a service we cannot supply or remove statutory refund rights.
10. Personal information and learners
The service uses account details, course-access records, practice progress and saved working to provide access, save learning work and respond to support requests. Cloudflare supports hosting and course-data storage; Supabase supports account authentication; Google Workspace supports account and support email. A payment provider will process card transactions when billing is connected.
A completed Privacy Notice, identifying the seller and its privacy contact, data purposes, service providers, transfers, retention practices and access/deletion procedures, must be made available before card enrolment opens. These subscription terms are not a substitute for that notice or for meaningful consent.
Contact info@pacedlearning.ca with privacy questions or requests. Parents and guardians must help younger learners understand how their information is used. Where a learner cannot give meaningful privacy consent, consent must be obtained from a parent or legal guardian. Marketing consent is not a condition of course access.
11. Educational disclaimer and reasonable care
The educational disclaimer below forms part of these terms. Paced Learning is supplementary self-paced practice, not a school, accredited credit course or guarantee of academic results. We will use reasonable care in supplying the service and handling reported content errors. The disclaimer does not excuse misrepresentation, remove an obligation imposed by law or waive a consumer remedy.
12. Changes to these terms or prices
The version accepted at enrolment governs that purchase. We will not retrospectively change charges, the trial deadline or your first-payment guarantee. Proposed material changes or price increases must be explained in advance, with the effective date and an opportunity to cancel before a changed renewal charge. We will obtain any further consent required by law.
A website update alone does not establish that you accepted new payment terms. Keep the confirmation and terms provided with your purchase.
13. Consumer rights and disputes
Nothing in these terms or the disclaimer excludes or limits any non-waivable consumer right, cancellation right, warranty, remedy or statutory standard of service. The 14-day guarantee is an additional commercial promise and does not replace rights under applicable law.
Ontario law and applicable federal Canadian law govern this agreement, subject to any mandatory protections that apply where you live. Contact info@pacedlearning.ca to seek a resolution. These terms do not require mandatory arbitration or waive the right to approach a regulator, bring an eligible court claim or participate in proceedings where protected by law.
If a provision is unenforceable, the remaining provisions continue only to the extent permitted by law.
14. Order-specific record to supply at enrolment
Each completed order must identify: the legal seller and business contact details; purchaser and student account; selected course; monthly or quarterly plan; trial start and end times; first payment date; CAD subscription fee, applicable taxes and total charge; renewal frequency and next renewal date; cancellation and refund methods; accepted terms version; and the time and record of express recurring-payment consent.
